Terms and Conditions for Clients

    1. Consent to Use of Personal Data
      By reaching out to EduHeart through any means (e.g. request form, messaging apps, phone call), you agree to allow EduHeart to collect and use your personal data for the following purposes in line with the Personal Data Protection Act (PDPA) 2012:
      • To contact you about your tuition needs
      • To process and manage the tutor-matching service
      • To share your details with the tutor once lessons are confirmed
      • To send you updates or promotions via email or messaging apps (such as WhatsApp, SMS, or Telegram).

    2.  Agreement to These Terms
      When you confirm a tutor through EduHeart, either by receiving a confirmation message (SMS/Email/WhatsApp) or by starting the first lesson, you agree to the terms and conditions stated in this document.
    3. Fees and Commission
      EduHeart’s tutor-matching service is free for clients. Our commission is charged to tutors. After the first two weeks of lessons (or as otherwise specified), the client will make payment to EduHeart for the agreed amount, covering both the tutor’s lesson fees and the commission. This can be paid via PayNow, PayLah or bank transfer.

      After this initial payment, future payments can be made directly to the tutor in any form mutually agreed upon. These direct payments do not include commission or additional charges.
      If new services are added, such as another subject or additional students (e.g. siblings) EduHeart must be informed. Commission applies for these new services as well.
      In short-term arrangements (four or fewer lessons), clients may agree to bear the commission to help secure a tutor more quickly. Once this arrangement is agreed upon, it cannot be switched to the standard tutor-bears-commission model, even if more lessons are added later.

    4. Replacing or Cancelling a Tutor If you find the assigned tutor unsuitable during the first month, you may request a replacement after at least one lesson has taken place. You will only be billed for lessons already conducted.
      If lessons are cancelled before four weeks are completed, the client is required to pay 50% of the total fees owed for lessons conducted. EduHeart will invoice you accordingly. You may either pay the tutor directly or request that EduHeart forward the tutor’s share on your behalf.
      We understand that urgent or unexpected situations may arise. These cases will be handled with flexibility and understanding.
      If a tutor cancels due to personal matters or any other reasons, the lessons conducted prior to cancellation are generally still payable. EduHeart will review each situation and determine the fairest outcome. By accepting these terms, you agree to respect EduHeart’s final decision in such matters.
    5. First Lesson Cancellations or Changes
      If you need to postpone or cancel the first lesson, please give at least 4 hours’ notice to EduHeart or the tutor. If not, you will be charged 50% of the agreed lesson fee as a goodwill payment to cover the tutor’s time and travel, and EduHeart’s service. This amount will be shared equally between EduHeart and the tutor. Emergency cases will be reviewed individually.
    6. Late Payment Charges
      EduHeart reserves the right to charge a late fee of $50 every 14 days for payments overdue by more than a month. If additional follow-up or administrative work is needed to collect the payment, further fees may be added, depending on the situation.
      Example: Mrs Lee hired a tutor on 1st March at $60/hour for 1.5 hours per week. She owed $180 after two sessions, but missed the due date of 10th March. After reminders and a grace period of one month, payment was still not made by 10th April. Starting 11th April, late charges of $50 every two weeks began. When she finally paid on 11th May, she had to pay $280 in total — $180 in lesson fees plus $100 in late charges.
      If payment is not received within 3 months, EduHeart may file a claim through the Small Claims Tribunal. We may also take legal steps earlier if recovery through other means seems unlikely. Late charges will continue to apply until a court order is issued.
    7. Tutor Qualifications
      You may request to see a tutor’s academic certifications. EduHeart will try to obtain these documents for your reference if the tutor agrees to share them.
      While we carry out screening and verification steps internally, we cannot guarantee that all tutor information is 100% accurate. If you suspect a tutor has misrepresented themselves, please notify us immediately. We will support you in reporting the case to the relevant authorities.
    8. Lesson Rates and Timing
      After the first lesson, you may arrange the schedule and rates directly with the tutor, especially if the student progresses to a higher academic level. All changes should be mutually agreed upon between tutor and client.
    9. Lesson Venue
      Lessons will take place at the address provided by the client unless another location is agreed upon.
    10. Misconduct and Fee Evasion
      Any attempt to bypass or avoid EduHeart’s commission — such as arranging a direct engagement with a tutor we matched — will be treated seriously. EduHeart may take legal action and report such behaviour to the authorities.
    11. Quality and Outcome of Lessons
      EduHeart cannot promise specific results or improvements in academic grades. However, we aim to connect you with tutors who best fit your learning needs and preferences.
      All lessons conducted are chargeable. If you are unhappy with the service, you may cancel at any time. We welcome all feedback and will use it to improve our service.
    12. Legal Limitations
      EduHeart acts as a facilitator between tutor and client. While we are happy to help resolve any misunderstandings, we are not legally responsible for actions taken by either party once lessons have started.
      We reserve the right to decline, withhold, or discontinue service at our discretion, unless otherwise required by law.
    13. Updates to These Terms
      EduHeart may change or update these Terms and Conditions at any time without prior notice.

Privacy Policy

  1. Data Protection
    EduHeart is committed to protecting your personal information. We will never rent, sell, or disclose your data except where necessary to provide our tuition services.
  2. Information Shared with Tutors
    Information such as location, subject, and lesson preferences may be shared with tutors during the matching process. Your full address and contact number will only be released after a tutor has been confirmed.
  3. Information Shared with Clients
    Tutors’ relevant information (qualifications, gender, teaching experience) will be shown to clients. Personal details like phone numbers or identification numbers are only shared after the assignment is confirmed.
  4. Website and System Tracking
    As a digital platform, EduHeart may collect data such as your IP address and session activity to improve our website and services.
  5. Legal Requests
    If required by law, EduHeart will disclose personal information to comply with legal or regulatory requests.
  6. Tutor Assignment Portal
    Our internal system requires tutors to log in using verified contact details. By using this system, tutors agree to allow their profile (excluding private data) to be viewable for tuition matching purposes.
  7. Changes to Policy
